Upcoming Changes in Tax Audits: Prepare for the Introduction of the National e-Invoice System (KSeF)

Huge audits by tax offices are coming. So far, they have been carried out selectively, with the possibility of viewing taxpayers’ bank accounts. However, from mid-2024, this situation is to change dramatically. Everyone is afraid, not only the dishonest ones

Changes in the law mean that Tax Offices will not have to visit companies to carry out inspections. Instead, most information will be available electronically. This means greater control possibilities and financial analyzes for state institutions.

The most important change is the introduction of the National e-Invoice System (KSeF) from July 1, 2024. It will be a platform for generating, storing and sending invoices in electronic form. The system is designed to more effectively analyze and verify tax authorities.

On the one hand, KSeF can significantly simplify the process of issuing invoices, but on the other hand, it introduces stringent sanctions. The penalty for issuing an invoice outside the system may amount to up to 100% of the tax value or 18.7% of the total invoice value. Moreover, there is concern about the risk of penalties for technical errors related to software.

Apparently, the tax authorities will not impose penalties at the very beginning, drawing taxpayers’ attention to errors when completing documents so that taxpayers get used to this system. The system also has its advantages for taxpayers, i.e. faster tax refund and no obligation to keep documentation for 10 years. From now on, documentation will be stored online and taxpayers will no longer have to keep binders with files of invoices from the last 10 years.

The new regulations aim to increase transparency in the area of ​​taxation and fight tax fraud. On the one hand, they can make life easier for honest entrepreneurs, but on the other hand, they can introduce additional burdens and the risk of penalties. It is important for entrepreneurs to understand the new regulations well and adapt to them early enough. Time is running out, because all regulations regarding e-invoices will be introduced in July.
