The consumer is encouraged to participate in the “project” as an investor in the sales system in exchange for a promise of remuneration or other material benefits, which depend primarily on the introduction of new people to the system , and not on the sale or consumption of products – explains UOKiK.

– We must eliminate pyramid-type promotional systems faster and more effectively. Promoting them is an unfair market practice that violates the collective interests of consumers. The Office initiated proceedings against the so-called touts, i.e. bloggers or celebrities who encourage on their websites, in social media or in recordings to invest in such projects and attract more people to them.

– These people profit from reprimanding illegal systems, they lie to consumers and mislead them with the vision of great profits. Without the activity of touts, many financial losses, suffering, and sometimes human tragedies can be avoided. We want to persuade them to stop this malicious activity and warn consumers against such practices – this is what the first proceedings in which I accused people promoting pyramid-type promotional systems – emphasizes the President of UOKiK.

At the same time, an entrepreneur is considered not only a person registered in CEIDG, but everyone – including bloggers, infuencers, who in an organized and continuous manner actually runs a business and derives profits from establishing, running or promoting pyramid-type promotional systems.

The law also provides for sanctions for managers who intentionally infringed the collective interests of consumers. It is a maximum of PLN 2 million. A financial penalty against a managing person may be imposed in a decision in which the President of UOKiK will impose a penalty on the company managed by such a person.
