Al-Huzaimi said, I want to change the hadith, for now there is a lot of talk about the development of the fiqh, but this development is not just about problems.
And he continued, jurisprudence must be developed through the texts of the colleges, for example, when the Messenger, peace be upon him, comes and says: “You know your worldly affairs”. In this case, anything that contradicts this text will be considered.
And he added, and one of the issues that needs to be considered is the question of the “waiting period of a pregnant woman”. It is not reasonable for medicine to confirm that a woman cannot get pregnant for more than 9 months, and jurists come to say “the waiting period of a pregnant woman is 4 years.” This is not possible and must develop jurisprudence through texts.
