Unpaid Traffic Fines: Defendants Refuse to Pay, Even if Not Behind the Wheel | Thionville Police Court

Thursday October 26, the Thionville police court continued the cases of unpaid traffic fines, following excessive speeding. The defendants, owners of the flashed cars, refuse to pay them. They maintain they were not behind the wheel. And even if it’s true, it’s not enough.

The police court judges the perpetrators of contraventions. Thursday October 26, in Thionville, the hearing no longer included those defendants liable for a traffic fine.Everyone has good excuses for not having paid. All appeared without a lawyer.

The first advances to the bar aided by a cane. Widow, 66 years old, model driver, she repeats that she was not at the wheel of her car between Metz and Nancy, flashed 10 km/h above the limit, in a work zone. She can prove it but that’s not the point. “We don’t blame you for driving your car, ma’am,” the president clarified. The law is clear: even if the owner of the vehicle is not behind the wheel, she is financially responsible. It is therefore up to her to pay the fine. It will be 100 euros.

The judgment will not appear on the criminal record. No points will be removed from the license. The detail did not escape the drivers, who subscribe to the points recovery courses.

Flashed four times in one week

The next motorist, 23 years old, only has one small point out of twelve. He is also known for traffic offenses. His license plate was flashed four times in one week, in February 2022 in Thionville, on a departmental road which leads to Luxembourg where he works. He says he filed a complaint about the theft of plates a month earlier. “I think you’re lying to us.” I think you made a false report of theft. I think you are wasting our time,” replies the deputy police commissioner, an officer of the public prosecutor. The court sets the amount of the four cumulative fines at 1,550 euros.

The same name usurped in 500 fine notices

A third defendant is 35 years old and has quite a few speeding tickets on the clock. His car was fined in Landes in December 2019. He had sold it a year earlier, without reporting it to the State. Which still made him responsible for the vehicle. Four years later, he will have to pay a fine of 450 euros.

Latest case: that of a young woman of 28 years old. His car was traveling at 103 km/h instead of the authorized 80, at 3:30 a.m., near Malavillers (54). “I pointed out my father, he was the one driving,” she explains. Except that the declaration recorded on the dedicated site bears the name of an illustrious unknown person. A usurped name, used in more than 500 infraction notices to avoid the loss of points, according to the deputy commissioner. “It must be an administrative error,” maintains the girl. Nobody believes it. Amount of the fine: 750 euros.

Everyone has ten days to appeal.
