United States: Indiana becomes first state to approve abortion ban

A few weeks after the repeal of Roe v. Wade, Indiana becomes the first American state to restrict access to abortion on its territory. The text of the law, voted on Friday August 5, prohibits abortion with a few exceptions.

Dsince June 24, 2022, date of revocation of Roe v. wade in the United States, each American state has the right to decide its own abortion law on its territory. Following this Supreme Court decision, nine states announced their intention to make voluntary termination of pregnancy (abortion) illegal. However, until today, none had yet taken the step of modifying its legislation. It’s now done for Indiana. On Friday August 5, the state became the first in the country to officially prohibit abortion. The text of the law was voted by the local assembly, made up of the House of Representatives and the Senate, then promulgated in stride by Republican Governor Eric Holcomb.

This new legislation, which will come into force on September 15, almost completely prohibits the use of abortion, with some exceptions. Voluntary termination of pregnancy will indeed still be possible in Indiana in case of rape or incestbut also when the life and physical health of the mother are in danger or if a deadly abnormality is diagnosed in the fetus. Women affected by these situations will have up to ten weeks to abort. Until now, the American State authorized the mothers to terminate their pregnancy, and that, until twenty-two weeks.

A measure deemed “radical” by the White House

The passage of this restrictive law in Indiana did not take long to arouse strong reactions in the United States. The White House notably condemned this decision, arguing that it was a “radical new measure taken by elected Republicans to deprive women of their rights and their freedom in matters of procreation”, according to Karine Jean-Pierre, the spokeswoman for the White House.

Indiana becomes the fifteenth US state to restrict access to abortion and the eleventh to ban it almost completely, according to RTL. Conversely, progressive states strive to maintain this right on their territory. Voters in California, Michigan, Nevada and Vermont, for example, should soon vote in favor of measures protecting the use of abortion. More surprisingly, Kansas, a very conservative state, came out in favor of maintaining the right to abortion on Tuesday August 2.
