MODEL UNION MANDATES FOR NEGOTIATION OF COMPANY AGREEMENTS
° IN COMPANIES WITH 50 EMPLOYEES OR MORE:
In companies whose usual workforce is at least fifty employees, in the absence of union delegates in the company or establishment, the full members of the staff delegation of the social and economic committee may negotiate, conclude, revise or denounce collective work agreements if they are expressly mandated for this purpose by one or more representative trade union organizations in the branch to which the company belongs.
The same organization can only mandate one employee.
The representative trade union organizations in the branch to which the company falls are informed by the employer of its decision to initiate negotiations.
The validity of agreements or revision amendments concluded pursuant to this article is subject to their approval by employees by a majority of votes cast.
It is Article L. 2232-24 of the Labor Code.
° IN COMPANIES with 11 to LESS THAN 50 EMPLOYEES:
In companies whose the usual workforce is between eleven and less than fifty employees, in the absence of a union representative in the company or establishment, company or establishment agreements can be negotiated, concluded, revised or denounced :
- Either by one or more employees expressly mandated by one or more representative trade union organizations in the sector, being a member or not of the staff delegation of the social and economic committee. For this purpose, the same organization can only mandate one employee;
- Either by one or more full members of the staff delegation of the social and economic committee.
The agreements thus negotiated, concluded, revised or denounced may relate to all measures which can be negotiated by company or establishment agreement on the basis of this code.
It is Article L. 2232-23-1 of the Labor Code.
