Unemployment Insurance: Learn how to know if I have excess or “lag” of money in the AFC

The Unemployment Fund Administrator (AFC) informed that employers and affiliates may present possible undue or overpayments in their Unemployment Insurance contributions.

These payments, known as “lags”, are contributions monies that, for various reasons, should not be credited to your Individual Unemployment Insurance Account.

Therefore, if applicable, each person can request the respective refund of that money.

How can I check if I have money available?

According to what is indicated by the AFC, affiliates or employers who want to know if they have lags, can enter the site www.afc.cl.

Subsequently, you access the Affiliate Virtual Branch (with your personal password or Unique State Code) or to Employers Virtual Branch (with your employer code), as appropriate.

Then, enter the section “Lags” and check in the tab “Delays to return” if you register improper or overpayments.

If there are payments available, request a refund by entering the information required by the platform. You do not need to submit additional documentation.

How is a lag to be returned?

In the first place, it should be noted that Unemployment Insurance is a benefit that protects workers governed by the Labor Code in the event of being unemployed, and is financed mainly with the mandatory contributions provided by the employer and the worker, equivalent at 3% of the monthly taxable remuneration.

That said, the reasons why undue or excess payments to Unemployment Insurance may arise are:

  1. Retired worker, to whom the employer paid a contribution after the date of his pension.
  2. Payment of the contribution to an independent worker, where the RUT of the employer matches that of the affiliate.
  3. Payment of contribution to a worker under 18 years of age, which by law should not contribute to Unemployment Insurance.
  4. Full contribution payment to workers with more than 11 years of working seniorityl, since, by law, the maximum period of complete contribution for Unemployment Insurance is 11 years for each employment relationship. Once this period has expired, the employer only has to pay the contribution to the Solidarity Unemployment Fund (0.8% of the taxable income charged to the employer).
  5. Payment to a closed or non-existent bank account, or the payment records an expired voucher view.
  6. Payment of contribution to affiliate in excess, that is, for an amount greater than what is established by law.

Check if you have lags to clarify

There are also lags to be clarified. These correspond to payments of contributions that did not reach the Individual Account of the affiliates and that need to be processed, presenting the corresponding documentation to be credited to the Individual Unemployment Account.

As indicated by the Unemployment Fund Administrator, delays to be clarified may occur due to inconsistency of the affiliate’s or affiliate’s data, because the employment relationship is not created in the AFC records, due to payments corresponding to a terminated and undeclared employment relationship. by the employer, or inconsistency between the type of contract and the amounts quoted, among other reasons.

To consult in www.afc.cl, enter the Virtual Branch of Affiliates or the Virtual Branch of Employers, as appropriate. Then choose the section “Lags”, menu “Lags to be clarified” and know what documentation to submit and where to send it.
