UNE Lawyer Files Complaint Against TSE Magistrates for Possible Irregularities in Presidential Election

This Friday, August 25, the lawyer Carlos López Aquino, representing the National Unity of Hope (UNE) filed a complaint with the Public Ministry (MP) in which he accuses the magistrates of the Supreme Electoral Tribunal (TSE) of possible irregularities in the second electoral round for the Presidency in which Bernardo Arévalo was elected.

The green party’s complaint adds to the series of actions against officials of the electoral entity and the Seed Movement, carried out by the investigative entity, from the Special Prosecutor’s Office Against Impunity (FECI), in charge of Rafael Curruchiche, who worked together to López Aquino in the Electoral Crimes Prosecutor’s Office.

UNE LAWYER WAS IN THE PROSECUTOR’S OFFICE FOR ELECTORAL CRIMES DIRECTED BY CURRUCHICHE

During 2021 and 2022, the Attorney General of the investigative entity María Consuelo Porras, made a series of changes and dismissals in several of the most relevant prosecutor’s offices, including the FECI, which was directed by Juan Francisco Sandoval, until July 23, 2021.

Days after Sandoval’s departure, the Attorney General appointed Carla Valenzuela in charge of the FECI, however, Porras decided that it would be Curruchiche who would finally have command of the Prosecutor’s Office, on August 3.

Separately, Porras decided to change the position of one of the prosecutors who accompanied Curruchiche in the Electoral Crimes Prosecutor’s Office, in September 2021. The head of the investigative entity sent the now UNE lawyer, López Aquino, to the Sipacate Prosecutor’s Office , Escuintla.

Said change was consigned by La Hora in the note titled as “Consuelo Porras orders the transfer of the prosecutor who investigated Pérez Leal”in which it is detailed that he would have had differences with Curruchiche, since he would not have authorized a case he was investigating, however, both knew each other within the Prosecutor’s Office.

FROM PROSECUTOR TO UNE LAWYER

López Aquino returned to the electoral field as a UNE lawyer, since this Friday he filed a complaint with the MP, in which he accuses the TSE magistrates for alleged anomalies during the second round of elections on August 20.

“We believe that the result of the voting was changed, changing the will of the people, which is expressed through the vote. We were able to determine these aspects, we found several divergences. For example, there is duplicity of records,” said López Aquino.

According to the ex-prosecutor, there was also a precipitation in the scrutiny, since the TSE determined that the stipulated time for the process was 45 minutes, but that at 6:00 p.m. some polling stations were transmitting the votes.

At the same time, it indicated that “it was possible to establish that there were voting centers that did not have internet or a computer center, and they had to transfer the electoral record to another nearest voting center that had these supplies, but those electoral centers they were already transmitting the data, it is totally hasty”.

In addition, it indicated that it is known that “another system different from the Transmission of Preliminary Electoral Results (TREP) was used, since its delegates reported that the data entry workers were told that the TREP had problems, and that they should use another system, which raises doubts where that information was entered.”

FECI INCREASES ACTIONS AGAINST TSE AND SEED

After knowing the electoral victory of the Seed Movement in the second round for the Presidency, the FECI continued the actions against the political group, as well as against TSE officials, since it required information on the Departmental Electoral Boards (JED), Receiving Boards of Votes (JRV), as well as reviewers, data entry workers, voting centers and their coordinators.

In addition, the Electoral Crimes Prosecutor’s Office requested the lifting of the immunity of the Registrar of Citizens, Ramiro Muñoz, as well as against the president of the electoral entity, Irma Palencia, the titular magistrate, Mynor Franco, as well as the substitute magistrate, Álvaro Cordón.
