ProLiga, which brings together almost 300 clubs from Second B, Third division and the rest of the lower categories of Spanish football, has warned of the existence of numerous appeals presented before the Administrative Court of Sport (TAD) Throughout the season they are “pending resolution for more than two months”, a situation that, according to the association chaired by David Jiménez, may mean that “competitions are distorted when there are points at stake.” Faced with this situation, ProLiga has requested the Higher Sports Council (CSD) a restructuring of the TAD and the creation of one with exclusive dedication of its components so that it can meet daily, and not once a week as is currently the case, to resolve the pending resources in the shortest possible time.
«ProLiga has addressed the CSD showing its concern that to date there are pending appeals to be resolved and that were filed more than two months ago, especially when many of them have an impact on the classification as they are cases of improper alignment “, explains the association.
This weekend the first phase of the League closes in Second B and ProLiga warns that the delay in the resolutions «distorts the competition, running the serious risk that resolutions will be issued with an impact on the classification once the second phases of the national championships of that category have begun, but also of the Third Division, being able to see clubs harmed by these late resolutions ”.
As a solution to the problem, ProLiga proposes to the CSD a restructuring of the CAS so that you can meet every day and not once a week, as it happens now. A body that, as understood by this association, should be “divided into sections or sports disciplines” and whose members must be “ad hoc” according to the sport discipline.
ProLiga remembers that the TAD it meets “once a week (exceptionally one more day) and they have to resolve disciplinary proceedings in the 66 Spanish sports disciplines in that weekly meeting and in just a few hours.” “Both due to the number of affiliates (almost 10% of the total population of Spain), as well as the existence of 66 Disciplinary Codes (one for each sporting discipline) and in order to comply with article 24 of the Spanish Constitution and not cause defenselessness ”, ProLiga considers that the solution to resolve the pending appeals and that the competition is not affected is through a restructuring of the CAS.
