Understanding the Order: Adapting Health Legislation for French Territories

The basics of the order

The ordinance, taken on the basis of Article 74-1 of the Constitution, has the main objective of making applicable, in Wallis-and-Futuna, New Caledonia and French Polynesia, in their version applicable in mainland France, the recent provisions of the Public Health Code relating to research involving the human person, which make it possible to specify the conditions under which this research can be carried out and to guarantee the safety and good information of the participant.

In addition, it extends and adapts to these overseas territories various legislative provisions relating to health, in compliance with the sharing of powers between the State and each of these communities, in particular:
