Understanding Proper Service of Subpoenas: Personal Delivery and Video Recording with Signature

Proper service of subpoenas exists in only two ways. First – personal delivery, under video recording, with a signature. Second – delivery through the administration of the place of work.

This was told by lawyer Rostislav Kravets.

“The most important thing is to make sure that it was you who received the agenda, that it was you who signed it. If there is some kind of “squiggle” in the summons, there is no evidence, no video is recorded, there are no witnesses that it was you who received this summons, such protocols and such fines will be canceled by the courts. On on the basis of the summons, where there is a “squiggle”, there is no evidence, witnesses or video material, it was you who were given this summons, it will be illegal”, – he said.

Summons at roadblocks

The lawyer emphasized that the subpoenas at roadblocks, if there are squiggles, and not the signature of a person liable for military service, they have no legal significance. If there is a signature and everything is fixed, this is a legal delivery.

Summons to relatives, acquaintances, condominiums, housing offices

“As for giving relatives, acquaintances, at the place of residence, condominiums, housing departments — this is also not proper service of the subpoena. There is no evidence that the person directly received this summons. Even if they issued a summons to his wife, relative, grandmother, mother, father – no. If the subpoena was not given to the person liable for military service, this is also not a confirmation of the proper delivery of the subpoena,” Kravets emphasized.

Alerts at work

If the summons was brought to the place of work, it will be a proper service.

“In this case, either the company must report that you either went on vacation at your own expense, or on sick leave, and it did not have time to serve the summons. It will be liable if it did not serve the summons, and you were at work,” he added.
