NATIONAL INFO – BPJS Watch member Timboel Siregar considers that BPJS Health is under the coordination of the Ministry of Health. This is in accordance with the interpretation of the Health Bill Chapter XIII Article 425 which states that the BPJS is a public legal entity and is responsible to the President through the Minister of Health.
According to Timboel, the word “through the Minister of Health” in Article 425 positions BPJS in managing the JKN program under the Minister of Health. Moreover, this Health Bill also contains provisions regarding the obligation of the BPJS to carry out the assignment of the Minister of Health. Not only that, the Health Bill also regulates BPJS reports to the President through the Minister of Health.
This means that the management of JKN up to reporting by BPJS Health must obtain approval from the Minister of Health, prior to going to the President. “This is the same as the position of BUMN companies which are under the State Minister for BUMN,” said Timboel in a release, Thursday, March 16, 2023.
“If it is said that it is limited to coordination, in fact all this time the coordination process has been carried out by the Coordinating Minister for PMK, so if the word ‘through the Minister of Health’ in Article 425 is interpreted as limited to coordination, in my opinion that is not correct.”
