The Palermo review court has again ordered the seizure of the building that, in the Sicilian capital, houses the new Virgin gym. The judges of the panel chaired by Salvatore Fausto Flaccovio accepted the appeal presented by the pool coordinated by the deputy prosecutor Sergio Demontis.
The provision – apart from the fact that for the anti Covid provisions the gyms are all closed for now – will become operational when the terms expire or the possible further appeal, which the defense of Euro Real Estate can propose, this time in Cassation, will be rejected.
The building in via Gioacchino Ventura had been seized in October by the prosecutor for building abuses and problems of static. The lawyer Sergio Monaco, who assists the legal representative of the owner company, Filippo Basile, 41, had, however, obtained the release from seizure from the investigating judge Fabio Pilato and the newly renovated building was back in the availability of the owners and tenants of Virgin Active.
Euroleasing Company spa, another interested company, in its capacity as co-owner of the building hosting Virgin, had demonstrated to the judge that the renovations had been carried out in violation of the law and that the building permit had not been requested, but only because the declaration of commencement of activity had been presented, a circumstance that had saved 59 thousand euros of urbanization costs, which remained in any case seized, unlike the building.
In fact, the judge recognized that there was no danger of collapse and for this he had ordered the restitution to the owners and tenants of the property. In the investigation that led to the seizure there are six suspects: in addition to Filippo Basile, Antonino Lo Duca, designer and director of the works carried out to expand the structure, Tommaso Castagna, owner of the company executing the works and officials of the Municipality, the architect Giuseppe Monteleone, manager in charge of the one-stop shop for productive activities (already involved in the investigation and in the two-faced Giano trial), Antonino Zanca and Sergio Marinaro, who instructed the practice.
