In Ukraine, for debts on a communal apartment, they can take an apartment. For this, the amount of debt must exceed UAH 120 thousand.
This is stated in OBOZREVATEL material… During the coronavirus pandemic, they cannot pick up the only apartment for communal debts. But if there are two apartments, then the second can be sold. Also, as part of debt collection, they can take away and sell at auction a car, household appliances, clothes and even dishes. For each family member, they must leave the required minimum. For example, if the apartment has only one sofa, they will not take it away.
“If we are talking about a car or other property of secondary importance, the legislation continues to operate in the format in which it operated,” they said OBOZREVATEL in the Ministry of Justice.
Bogdan’s lawyer Motuzyuk adds: they can pick up an apartment if the debt exceeds UAH 120 thousand. For utility bills, the procedure is simpler than usual. You can recover on the basis of a court order or consider the case in a simplified action procedure.
“After that, a document is issued on the basis of which the supplier can go to the contractor and open enforcement proceedings.” Motuzyuk says. “Already in this proceeding, they determine what property the debtor has. If he does not have any income, funds, other property, at the expense of which it is possible to cover the debt, then the collection of real estate is quite possible. “
According to the law, you will be charged a penalty fee, inflation and 3% per annum for the amount owed.… In addition, the service provider has every right to turn off the communal apartment until the debt is paid off. If, after 3 days from the receipt of such notification, the consumer has not paid the debt or has not independently stopped gas consumption, then the service provider has the right to stop gas supply.
As reported OBOZREVATEL, in Ukraine debtors on communal apartments will be fined by 20-50%, at the same time, they will be prohibited from traveling abroad.
Such innovations will reduce the number of those Ukrainians who can pay their bills, but do not. This is stated in the bill №3613, which was included in the agenda of the Verkhovna Rada. The profile committee recommends the adoption of the specified document.
