The tax office will receive more data
In Ukraine, as part of the National Revenue Strategy, they plan to abolish banking secrecy. If now the tax office only transmits information about the opening of accounts, then in the coming years they will also want to disclose information about the status of the account (how much money is received).
This is stated in the material OBOZ.UA. Thus, the tax office will have access to banking information of Ukrainians. “Control authorities will be given the opportunity to strengthen control over the income and expenses of individuals by providing regulatory authorities with access to banking information on the movement of funds in taxpayers’ accounts,” the statement says.
In fact, the current law already greatly expands the tax authorities’ ability to disclose bank secrecy. Article 62 of the Law “On Banks and Banking Activities” states that bank secrecy can be disclosed upon written request from the tax authorities.
Also, the Ministry of Finance, when verifying recipients of any state payment (pensions, benefits, subsidies, etc.), has the right to gain access to bank secrets. All you have to do is write a letter to the tax office. Notaries, executors of court decisions, law enforcement officers, and those who have received a court decision can reveal bank secrecy.
“Information about the activities and financial condition of the client, which became known to the bank in the process of servicing the client and relationships with him or became known to third parties when providing bank services or performing functions specified by law, as well as the information about the bank specified in this article is a banking secret.” , says the law.
As OBOZ.UA reported, all major taxes in Ukraine will be brought into compliance with EU legislation. However, it is not yet possible to talk about specific dates for carrying out tax reform – the Verkhovna Rada itself expects that this will happen only “after the war.”
