The document was prepared to implement the protocol of the meeting on preventing circumvention of sanctions in the fuel and energy complex, held on July 26, 2023 in the Office of the National Security and Defense Council of Ukraine, and to renew fuel quality requirements at a level not lower than Euro 5.
The draft act intends to make changes to the Technical Regulations:
- regarding the renewal of fuel quality requirements at a level not lower than Euro 5;
- addition of the necessary provisions regarding the implementation of Directive No. 98/70/EC and Directive No. 1999/32/EC regarding: ban on the sale of leaded petrol.
- establishing requirements for fuels used in road vehicles and non-road mobile machinery (including inland navigation vessels), agricultural and forestry tractors and recreational vessels (Articles 3 and 4 of Directive No. 98/70/EC).
Rationale
As noted in the explanatory note, by Resolution of the Cabinet of Ministers dated May 13, 2022 No. 570, changes were made to the Technical Regulations, allowing circulation on the market of motor gasoline and diesel fuel according to the environmental class Euro 3 and Euro 4 until the end or lifting of martial law in Ukraine.
This was due to the need to resolve the situation with the supply of fuel, given the critical situation that arose due to the destruction of oil depots, oil and gas processing plants, as well as the blocking of traditional routes for the supply of petroleum products as a result of the armed aggression of the Russian Federation.
“As of today, new routes for the supply of petroleum products have been established, market participants have concluded long-term contracts with European producers and international traders, the situation on the fuel market is stable. The needs of the state economy, the Armed Forces of Ukraine and other consumers are met with gasoline and diesel fuel of appropriate quality and in the required volume.” , says the document.
