Ukraine Courts Sentencing Evaders to Real Prison Sentences: What Changed?

According to the prosecutor’s office, we are talking about cases that occurred in the Mukachevo and Tyachevo regions.

Previously, men were released from serving their sentencesif during the probationary period they do not commit a new criminal offense and fulfill the duties assigned to them,” Ekaterina Khizhnyak told us.

According to her, prosecutors from the Mukachevo and Tyachiv district prosecutor’s offices appealed such decisions on appeal.

“So, in December last year, a 34-year-old Mukacheve resident passed a military medical commission at the recruitment center, received a summons to be sent to a military unit, but ignored the requirements specified in it. A month after this, a 47-year-old resident of the village of Kalina also avoided mobilization , which is in the Tyachiv region. He passed the Military Military Command, after which he wrote a statement about his refusal to do military service, realizing the criminal liability for this.

In May-June of this year, citizens were sentenced to 4 years in prison with a probationary period of 2 and 3 years, respectively. In appeals, the prosecutor’s office asked to cancel the verdicts of the courts of first instance regarding the imposed punishment and accept new ones. The Transcarpathian Court of Appeal supported this position and sentenced both defendants to 3 years in prison for the criminal offenses committed.”– said Ekaterina Khizhnyak.

According to law enforcement officials, there may be more verdicts appealed in the future.

To this, the lawyer adds that criminal liability for a person liable for military service begins after the latter received a summons, but, for example, did not go to the military unit.
