Ukraine Cancels ‘Limitedly Fit’ Status: What It Means for Military Personnel and Conscripts

“Limitedly suitable” no longer exists, the president signed the corresponding document. What the abolition of this status implies is already explained in the Ministry of Defense. How much time do you have to go through a second military training test, under what conditions can you leave the army, and what “surprise” awaits those liable for military service?

The “restricted fit” status has been cancelled: what next?

On April 3, Law No. 3621-IX, signed by President Vladimir Zelensky, was published, which, in particular, provides for the abolition of the “limitedly fit” status. The Ministry of Defense promptly clarified what awaits military personnel and those liable for military service who have this status. Therefore, canceling the “restricted” status does not automatically change to another status (fit or unfit).

Citizens who have been found to be of “limited fitness” must re-pass a military medical examination within 9 months after the law comes into force. That is, the powers that be decided to act ahead of the curve and not wait for the adoption of a new bill on mobilization, but to act faster and included this provision in another bill, which was successfully voted and signed by the President of Ukraine. By the way, Deputy Minister of Defense of Ukraine Natalya Kalmykova announced such changes the day before during a telethon. Moreover, according to Kalmykova, this should “make life easier for tens of thousands of people.”

What do the Ministry of Defense say?

The Ministry of Defense emphasizes that after re-examination, military personnel who are found unfit will be dismissed from military service, but those found fit will continue to serve. Those liable for military service who are found unfit will be excluded from the military register, and those who are found fit will go to defend the country. Everything seems to be clear. However, there were some “surprises”. It turns out that after the law comes into force, the government has 3 months to adopt the relevant regulations that define an updated list of diseases to determine suitability/unsuitability for military service. I wonder if this list will include, for example, heart disease, poor vision, diabetes, etc.? As practice shows, now, even with such diseases, people are “rown” by representatives of the TCC, and then we read obituaries in the press. And these men die not at the front, but after visiting the TCC and passing the VLK. By the way, not only civilians are shouting about the “correct” conclusions of the VLK and the “conscientious” work of the TCC. The military themselves pay attention to this. Journalist and writer, and now serviceman Stanislav Aseev, spoke about the consequences of canceling the “limitedly suitable” status for those liable for military service. He stated this in a commentary to Radio Liberty.

“I saw a man who was visually impaired, and he was registered as a sniper, this is almost a joke. Secondly, I came across people when I was already in the hospital, they took a blood test and discovered hepatitis. And this was supposed to reveal VLK, and not when they got into “training”. It is unknown how objectively the VLK will evaluate people who are of limited fitness and in what direction they will do it. Health. Therefore, most of the brethren with whom we discussed this are skeptical and with a certain mistrust”

Changes in military service

In turn, the head of the Ukrainian Center for the Protection of Human Rights Lyudmila Denisova also spoke about what has changed for Ukrainians in the matter of military service and mobilization. She reported this on the Espresso TV channel.

“Let me remind you that on May 4, a law will come into force that removes some privileges for military personnel recognized as unfit for military service in peacetime, or limitedly suitable for military service in wartime. Now there will be no such concepts at all, or are you a military man fit for military service or unfit”

Now the only reason for dismissal from military service can be unfitness, Denisova noted.

“If there were such grounds for dismissal from military service, the serviceman was recognized as limitedly fit for military service in wartime, such a right no longer applies to these categories. That is, now the reason for dismissal from military service can only be unsuitability. The same condition was o termination of a contract with military personnel when the serviceman was found to be of limited fitness for military service. Now this is only possible when the person is found to be unfit for military service.”

The human rights activist also commented on the increase in the age limit for registration of conscripts and named the conditions under which those liable for military service can mobilize from today.

“The norm was adopted by parliament in the summer of 2023, only now the president signed this law. Today, April 4, it comes into force. This means that all men 25, 26 years old, who have been registered as military conscripts to this day, will now become liable for military service, and can be mobilized for military service if they are fit for health reasons.

How much time do you have?

Let us remind you that on March 21, the Verkhovna Rada of Ukraine adopted a law on ensuring the rights of military personnel and police officers to social protection. It is this that provides for the complete abolition of the “limitedly fit” status, therefore all military personnel and those liable for military service who have it must re-pass the VLC. The President has already signed this document and was published on the Verkhovna Rada website. Note that the law abolishing the “limitedly fit” status will come into force exactly one month after its publication – on May 4. That is, “everything about everything” for everyone who now has this status has 9 months. During this period, it is necessary to re-pass the VLK and confirm the status of “fit” or “unfit” for military service. The deadline is February 4, 2025.

Earlier, it finally became known whether electronic summonses would be sent to Ukrainians.
