Two years in prison for domestic violence for woman who stabbed her ex-partner

The first-shift magistrate judge of the city of Libertad (San José) sentenced a 36-year-old woman to two years in prison as criminally responsible for a crime of domestic violence in formal concurrence with a crime of personal injury for stabbing her ex-partner with a knife last Thursday, August 29.

The convicted woman was under the influence of drugs when she attacked him from behind with the knife, after an argument.

The victim was treated by a mobile emergency service, then transferred to a local health centre and subsequently sent to Montevideo. The doctor who saw him at first confirmed the presence of a “stab wound in the right shoulder region”.

The couple had been in a romantic and cohabiting relationship for 11 years, and had separated approximately 10 days ago.

The 24-month prison sentence must be served as follows: six months under an effective prison regime and 18 months under a probation regime, according to article 295 BIS of the Code of Criminal Procedure.

In addition, the judge ordered the person to establish a residence, to be subject to permanent guidance and surveillance, to report once a week to the police station where he lives and to carry out community service for four hours a week for a period of 150 days.
