The specialized “Anti-corruption” unit of the Sofia City Prosecutor’s Office (SGP) specified the accusation of the former executive director of the National Palace of Culture, Miroslav Borshosh, for misappropriation of funds and brought two more charges against him – for intentional bankruptcy and conclusion of unprofitable transactions.
The prosecutor’s office announced today that after the preparation of the appointed additional forensic and economic expertise, the investigation of the “Anticorruption” SZ found that in the period from 23.08.2016 to 26.06.2017, Miroslav Boršos disposed of part of the targeted funds – in the amount of BGN 3,431,146.06 to be spent on paying expenses that are not related to the activities for which they were allocated. By decision of the Council of Ministers dated 03.08.2017, the budget of the National Palace of Culture was increased by BGN 17 million, and the funds were earmarked – for the reconstruction, modernization and adaptation of the main building of the National Palace of Culture for the needs of the Bulgarian Presidency of the Council of the European Union in 2018.
The collected evidence of harmful consequences for the state in a higher amount – BGN 3,431,146.06 – caused the “Anticorruption” SZ to file a precise charge against Borshosh for a crime under Art. 254A, paragraph 2 of the Criminal Code.
In the course of the investigation, evidence was also gathered for another crime committed by Miroslav Borshosh – intentional bankruptcy, which resulted in damage to the National Palace of Culture in the total amount of BGN 389,624.82/Art. 219 paragraph 4, in conjunction with paragraph 3, in conjunction with paragraph 1 in conjunction with Art. 26 paragraph 1 of the Criminal Code/.
In the period 16.01.2015 – 24.01.2017, he concluded contracts with law firms in the presence of appointed 2nd legal consultants, for the development of a website and the preparation of technical passports, with an existing website of the NDK and the creation of two technical passports of the building.
From the evidence collected and analyzed so far, it has also been established that in the period 24.11.2014 – 23.12.2015 Miroslav Borshosh knowingly entered into 15 unprofitable transactions, from which significant damages in the amount of BGN 94,740 occurred for NDK. The contracts are: 6 for PR-service, with 4 employees appointed to the NDK for this activity and 9 for procedural representation before judicial authorities, with 2 legal consultants appointed.
This evidence substantiates the accusation of Miroslav Borshosh for having committed a crime under Art. 220 paragraph 2 paragraph with paragraph 1 paragraph with Art. 26 paragraph 1 of the Criminal Code.
The allegation of bankruptcy remains unchanged, related to the concluded operating lease contract for the rental of a Lexus car, from which damages in the amount of BGN 28,399.61 have occurred for NDK.
The investigation continues.
