President Andrzej Duda has appointed a so-called neo-judge to conduct the election of a new president of the Civil Chamber of the Court. Prime Minister Donald Tusk has signed the decision. “The Prime Minister agreed, enabling the president’s unconstitutional actions,” notes judge Prof. Włodzimierz Wróbel.

The Polish Monitor published a resolution by President Andrzej Duda, in which he appointed Supreme Court judge Krzysztof Andrzej Wesołowski as the chairman of the assembly of judges who will choose a candidate for the position of President of the Supreme Court, who will direct the work of the Civil Chamber of the Supreme Court.
“At first I was convinced that it was too improbable to be possible. And yet,” commented Judge Wróbel, noting that he was a so-called neo-judge.
Wróblewski notes that “when politicians took over the Supreme Court, the president appointed a commissioner from among the new judges to conduct the vote for Prof. M. Manowska, whom he had chosen for the position of First President of the Supreme Court”. For the decision to be valid, the consent of the prime minister, then Mateusz Morawiecki, was necessary. “But for the current prime minister to sign the same maneuver today, allowing the political appointees of the previous government to maintain control over one of the most important parts of the Supreme Court?” – wrote the judge.

He stressed that “without the Prime Minister’s consent and his signature, such designation would be invalid and President Duda would not be able to appoint another political nominee to the position of President of this Chamber for the next three years.”
“But the Prime Minister agreed, enabling the President’s unconstitutional actions,” wrote the judge, adding ironically: “Restoring the rule of law“.
Judge Wróbel wasn’t the only one to speak out on the matter. “Hello Houston, is the Minister of Justice flying with us? This is a disgrace to the political class from both sides,” wrote judge Piotr. Gąciarek on X. “The Supreme Court judges are devastated, stunned. They feel betrayed,” said the president of Iustitia, judge Krystian Markiewicz, in an interview with oko.press.
