TSE requests CC intervention and presents new protections

After the raids carried out by the Public Ministry at the headquarters of the Supreme Electoral Tribunalthe entity’s magistrates appeared before the Constitutional Court to request its intervention and deliver two requests for protection, one against Attorney General Consuelo Porras and another against Judge A, of the Seventh Pluripersonal First Instance Criminal Court Fredy Orellana.

According to the magistrates, the actions of the Special Prosecutor’s Office Against Impunity denotes actions with the purpose of attacking the country’s democracy by requesting the official documents that contain the results of the elections of June 25 and August 20.

“We can gladly give them a certified copy and certify it in front of them, but for them to try to take the original minutes numbers 4 and 8 that contain the results is violating the will of the people expressed at the ballot boxes.”highlighted the president of the Court, Irma Palencia.

TSE protection actions

The two amparo actions seek to stop the proceedings that are currently being carried out at the Court’s headquarters, which according to Palencia could take several days, derived from the amount of information that the FECI is requiring, which is why they request the intervention of the Constitutional Court for them to rule on the matter.

Previously, the TSE presented a question of jurisdiction so that the CC could indicate whether Judge Orellana is competent to give electoral orders, since they consider that the judge is exceeding his functions by allowing the opening of the boxes and the request for documents.

“We are not opposed to the inspection, but we are opposed to the violation of the process”Palencia stressed.

The Court is expected to hear the requests submitted by the TSE and in the next few hours determine whether or not to process them.
