SANTO DOMINGO.- The Superior Electoral Court (TSE) ordered a new scrutiny of the votes cast in the election of the Bar Association last December 2, when accepting an appeal for protection filed in It is sense.
The court, presided over by Ygnacio Pascual Camacho Hidalgo, and composed of Rosa Perez de Garcia and Pedro Pablo Yermenos Forastieri, ruled that this sentence is executed within a period of no more than 5 business days, starting on Monday, January 15, 2024.
Likewise, that the vote count be done without application of “the alliance and regular agreements approved by resolution CNE-CARD-0099-2023, as it lacks legal effect.”
VIOLATIONS IN THE PROCESS
The TSE verified that the alliance pact that supports the results of the election was approved by the Resolution CNE-(CARD)-009-2023, adopted by the National Electoral Commission, on the same day of the elections at 3:00 in the afternoon, therefore it did not guarantee the publicity, electoral certainty and transparency, which requires due process within the framework of a union electoral contest.
“Likewise, the violation of the provisions contained in article 18 of the Electoral Regulations of the Bar Association of the Dominican Republic is observed, due to the fact that the alliance pact approved and concluded between Trajano Vidal Potentini, representing the National Consensus Guild Current and Diego José Arquímedes García Ovalles, representative of the Legal Dignity Guild Current, does not clearly establish which group heads the aforementioned alliance,” add the decision device.
LEAVES POTENTINI’S TRIUMPH WITHOUT EFFECT
The High Court made a decision that in fact annuls the victory attributed to Trajano Vidal Potentini, of the National Consensus iron.
Potentini and allies would have reached 11,473 votes, for 48.77% of those counted, surpassing Yohan López, from the Nuevos Tiempos group, who garnered 10,817 votes, for 45.96%, according to the questioned count.
