Tsatsarov is against extraordinary powers of the prosecutor’s office –

/ world today news/ The Chief Prosecutor Sotir Tsatsarov declared against the intentions of GERB to introduce extraordinary powers of the state prosecution. He believes that the intervention of state authorities in private legal relations can create dangerous precedents in the development of normal civil turnover. Perhaps the powers of the Minister of Finance in terms of protecting the state interest should be strengthened, prosecutor number one told journalists in the National Assembly.

“Then the question is, if all these amendments happen, will they help to undo this particular deal, because the vast majority of these deals that have led to such transfers have not happened on the territory of the country or have already happened . Let’s not create a superstructure that we don’t know in 2-3 years what results it will produce. It cannot be claimed that someone has accepted the proposals of the prosecutor’s office in the draft laws”, explained Sotir Tsatsarov to journalists in the parliament, reports “Focus”.

According to him, these proposals have been a fact since November last year, they appear in the latest monitoring report as a recommendation to strictly observe the strategy and proposals of the prosecutor’s office. “Anyone who thinks that almost any draft law has served the interests of the prosecutor’s office has either not read the monitoring report, or is very comfortable forgetting that such a bill exists,” said Sotir Tsatsarov.

Because of the proposed legal possibility – that the state prosecution can stop “dubious transactions” for 48 hours, the chief prosecutor met on Monday morning with Prime Minister Boyko Borisov, BNR reports.

At the end of last week, all parliamentary groups, with the exception of the Reform Bloc and the ABV, adopted in the first reading changes to the Civil Procedure Code, with which the prosecutor’s office was given the right to appear as a party in the civil process when there is an interest of the state, municipalities or of citizens enjoying special protection of the law.

Under these changes, prosecutors would be able to initiate civil proceedings. Tsatsarov’s assessment, with which Prime Minister Borisov also agreed, is that a dangerous precedent can be created in the development of normal civil turnover. The specific occasion – “a deal for 1 euro” cannot justify the changes, according to the chief prosecutor.

Sotir Tsatsarov also considers it unacceptable the intention, which is currently frozen, of deputies from GERB because of the “KTB” case, to be given the right to spoil private deals in 48 hours. The author of this idea, called by reformers and lawyers, extraordinary legislation, is Boyko Borisov, who explained that the idea was born during a meeting with representatives of the prosecution and services. The justice minister was one of the biggest critics of new powers for the prosecution.

According to the number one accuser, there are doubts as to whether the prosecutor’s office has the necessary capacity and integrity to exercise such rights downgrade the effect of such a law to the level of mere political populism. However, he finds that the granting of new powers in civil proceedings may create conditions for the intervention of state authorities in private legal relations and recalls.
