Thousands of people expected to witness the historic trial against former President Donald Trump on television this Monday in the case of altering business records to cover up a bribe to a porn actress, but a judge’s order prevented the trial from being televised.
New York court rules state that audiovisual coverage of trials is not permitted unless a media representative makes a request and the judge authorizes it.
“Coverage of judicial proceedings shall be permitted only upon order of the trial judge approving an oral or written request by a media representative for permission to conduct such coverage,” says section 131.3 of the Rules. of the Administrative Judge.
Why did Merchán refuse to broadcast Trump’s trial?
Although neither the judge nor the New York state unified court system have indicated the reasons for the trial to be broadcast on television, several sections of the judges’ rules may provide a clue as to Merchan’s reasons for objecting.
The same regulation indicates that to make a decision the judge must consult with the lawyers of all parties to the process, who will be responsible for identifying any concerns or objections of the parties, possible witnesses and victims.
In addition, he must evaluate “the type of case in question and whether the coverage would harm any participant,” says the regulation, which indicates that the judge must consider whether the transmission of the trial “would interfere with the impartial administration of justice, the progress of a trial just or the rights of the parties.”
Previously, both prosecutors and Trump’s legal team have expressed concern about media coverage of the case.
