The defense of the elected president Donald Trump has asked the judge Juan Merchanwho presides over the case of irregular payment to a former porn actress, and who has yet to hand down the sentence, to “immediately dismiss” the case in order to make way for an orderly transition of power in the country, as established by the Constitution.
“The immediate dismissal of this case is ordered by the federal Constitution, the Presidential Transition Law of 1963 and the interests of justice, in order to facilitate the orderly transition of the Executive branch”indicated lawyers Todd Blanche and Emil Bove in a letter sent on Tuesday and released this Wednesday.
In the letter, the lawyers ask Judge Juan Merchan for permission to present a motion with their arguments that will help him dismiss the case in which Trump was already found guilty by a jury in May of falsifying documents to hide the bribe payment he made to a porn actress, during her first electoral campaign in 2016.
The lawyers recall in their letter that the Constitution prohibits leaving in the hands of “a single prosecutor and grand jury the practical power to interfere with the ability of a popularly elected president to carry out his constitutional functions” after which he mentions presidential immunity – declared by the Supreme Court last July – among their arguments for dismissing the sentence that Merchan must issue.
“Just as a president is completely immune from any criminal prosecution, so is President Trump as president-elect”they state in their letter, in which they assure that continuing with the case would be “singularly destabilizing and would threaten to paralyze the operation of the government apparatus.”
They also ask the judge for a deadline until December 20 to present the motion with their arguments as to why the sentence should be dismissed.
According to the lawyers, on November 5, when Trump was elected to the presidency for the second time, the “people issued a mandate that supersedes the political motivations of the Manhattan Prosecutor’s Office,” which is handling the case against the president-elect.
The Prosecutor’s Office also sent a letter to Merchan yesterday in which they reported that they oppose the dismissal of the case, but leave the door open for the judge to postpone it until Trump ends his four-year term in 2029. EFE ( YO)
