TRUCHO LAWYER? ADVISOR TO SENATOR SERGIO BOTANA UNDER THE MAGNIFYING GLASS

In a recent complaint filed by lawyer Marcelo Gabito before the Rocha Police and referred to a Montevideo prosecutor’s office, Rodrigo Castillo, advisor to Senator Sergio Botana, is accused of committing alleged usurpation of title by presenting himself as a lawyer without having the corresponding academic qualification.

Gabito, the complainant, maintains that Castillo’s illicit conduct is manifested in his participation in a judicial case regarding mortgage foreclosure in Rocha. According to La Diaria, Castillo repeatedly presented himself as a lawyer, using the title “doctor” both in personal meetings and in email communications, where his business card made reference to “Guillermo Varela & Asociados. Dr. Rodrigo Castle”.

This complaint, which has caused a stir in political circles, invokes article 167 of the Penal Code, which contemplates financial sanctions for those who “claim academic titles or practice professions whose performance requires special authorization.” The sanctions provided range between 20 and 900 adjustable units.

Gabito argues that this legal provision seeks to protect “the prestige of the State and the community interest of being able to place trust in the professionals who act in the environment, as well as the prestige of the career and legal security.”

It should be noted that Castillo is part of a team linked to Senator Botana, contributing to the development of projects related to transportation and fuel policies, according to sources close to the legislator.

The complaint is not limited to Castillo alone; It also involves other actors. Notary Sandra Birriel faces accusations of falsification of a public document for recording a payment of $40,000 that, according to Gabito, cannot be supported and harms an 82-year-old woman.

Federico Guasp and María Cecilia Roca are denounced for fraudulent insolvency and division of assets between spouses to avoid the obligations contracted with the elderly woman.

Marcelo Gabito plans to present the case before the Supreme Court of Justice, invoking article 137 of the Organic Law of the Judiciary and Organization of the Courts, which grants the Court the power to regulate the registration and activity of lawyers. This case promises to generate repercussions not only in the legal sphere but also in the political sphere.
