A 29-year-old man almost survived a bloody act in a Vienna subway in June 2020. For a trivial occasion, a 25-year-old stabbed him in the chest with a knife with a blade length of 13 centimeters, whereby the stab channel reached a length of 13 centimeters. The blade just missed the heart, but went into the lungs. The defendant denied the intention to kill in the regional court on Monday in his trial for attempted murder.

The two men had never seen each other before. On June 25th last year, the accused sat with his partner in a U3 set, both of whom were drunk. The 29-year-old got on at the Volkstheater station, where his skateboard, which he was carrying, fell from his hand and fell to the ground. The 25-year-old made fun of it and laughed at the older man, who then made a short, sarcastic remark about an obviously black eye of the 25-year-old’s companion (“Is this new fashion?”).

Then the younger boy blew the fuses. He got up, went to the other man and looked for the confrontation which the 29-year-old wanted to avoid. With the words “Leave me alone!” He pushed his aggressive counterpart from him, at which point the subway door opened because you had just reached the next station. The 25-year-old stumbled out, lost his balance, came to rest on the platform, got up, drew a knife and jumped back inside before the doors closed again.

He followed the 29-year-old, who had walked briskly forward, caught up with him and, without a word, stabbed him with a first stab that the man could distract with his skateboard. The blade went into the left side of the collarbone. The second stitch, however, struck him two centimeters below the left nipple, opened the chest cavity, which filled with blood and air, and damaged the lungs. If the canal had run a few degrees differently, the artery or the heart would have been hit, the forensic doctor Christian Reiter now explained before a jury court (chaired by Christina Salzborn).

While the perpetrator and his companion fled after reaching the next stop – it was the Zieglergasse station – a female passenger was looking after the seriously injured man when she saw the blood. She led him to the platform where the man suffered a collapsed lung. He was first treated by alerted emergency services on the platform and then taken to Vienna General Hospital, where his wounds were treated.

As a witness, the 29-year-old now described that he had told the defendant that he should leave him alone when he noticed his willingness to use violence and the knife. Other passengers would have stayed out: “They must have been scared.” When he felt the consequences of the stab in the chest, “I thought that in the worst case, I could die. I was afraid that my mother would go to the funeral ”.

The defendant assured that he had never acted with intent to kill. He assumed that the 29-year-old would commit violence: “All of a sudden, his hand was with us. He was aggressive. I was afraid that it would concern us. ”When asked by the presiding judge, the 25-year-old admitted that he was“ angry ”because the other man had pushed him off the subway in front of his girlfriend.

Defense attorney Sinan Dikme (law firm: Rast / Musliu) focused on the difficult living conditions of his client. He grew up as the seventh of nine children, never met his father, never did an apprenticeship and last lived on the street. The stabbing was “a mistake”: “Everyone makes mistakes in his life.” The accused was not able to verbally solve “the problem”: “He wanted to incapacitate the victim.” Arm, want to stab the shoulder ”. Unfortunately, the view of the 29-year-old’s body was partially obscured, and the subway was in motion, which is why the blade missed its target.

The perpetrator had turned himself in to a police inspection shortly after the bloody act. There he stated that he had “done nonsense”.
