Motorcycle club member charged with assault –

A 32-year-old defendant from the Erlangen-Höchstadt district was presented with the receipt in court. His 43-year-old co-defendant from Cologne came out of the matter with a second class acquittal.
Exactly one year ago Max (name changed) wanted to hand over his club clothes to the boss of a motorcycle club in Franconian Switzerland. He doesn’t want to have anything to do with such bikers who have already dealt with the regional courts with their drug and violent crimes. In the boss’s apartment he meets two bull-necked two-wheeled friends who are unknown to him by name. He’s already seen one at the opening of the clubhouse. He’ll get to know the other person right away.
Confronted in the hallway
In the background there is apparently a conflict over a young woman from Nuremberg who is said to have threatened Max. You don’t do that as a gang member. There you catch one. “I confronted him in the hallway,” said the first defendant. When Max tries to leave him standing with “That doesn’t give you a shit”, the first defendant reacts. The fact that he needed the second defendant’s request to do so was the result of Max’s “blooming imagination”. But the punch that Max hits that evening is very real. With a double fracture of the lower jaw, Max moves away. The serious injury has to be fixed by an operation at the University Hospital Erlangen with the use of metal plates. For a few weeks he can only eat soft and pulpy foods. “I couldn’t shut my mouth anymore.”
The presence of a law enforcement officer showed that the local court also considers the rocker troop to be dangerous. Such a presence is not common in other processes. The new address of Max, who no longer lives in the Forchheim district, is also not read out before his testimony. He is afraid of the revenge of the bikers who don’t like to see one member testify against another.
While the first defendant openly admitted the act, criminal judge Silke Schneider could not be clearly certain that the second defendant was being instigated. Therefore, his proceedings were discontinued unconditionally and at the expense of the state treasury. A second class acquittal.
The already convicted thug was fined 120 daily rates of 38 euros. In addition to these 4560 euros, he also has to pay the process costs. Most expensive, however, will be the bill that the health insurance company will present to him for the treatments. His lawyer Nikolaus Gwosdek from Würzburg estimates this at around 10,000 euros. And then there will probably be compensation for pain and suffering.
