Following the Brexit, the European Union had to conclude a new judicial agreement with Great Britain, which regulates the conditions for the extradition of persons from European states to be prosecuted in the islands. According to the spokesman of the Ministry of Justice Vladimír Řepka, this agreement provides for a similar procedure as in the case of the previous so-called European arrest warrant.

“A similar procedure does not allow the transfer of a Czech citizen to the United Kingdom for criminal prosecution or execution of a sentence without his consent,” added Řepka to Práva.

However, according to the lawyers contacted by law, the evidence from the incident during the Slavia Prague match at the Glasgow Rangers stadium is very weak for possible accusations. Kudel’s lawyers do not want to evaluate the evidence.

Rangers football lawyer Glen Kamara, who was the target of the alleged verbal attack, informed that the police were going to accuse Kúdel. The Czech national team has not yet spoken to the Scottish police about the incident.

According to football player’s lawyer Radek Pokorný, the police have so far handed over the investigation to the public prosecutor for further steps. At the same time, evidence is gathered to decide whether or not to charge.

“At present, no charges have been filed, nor do we have any information that the public prosecutor is going to do so. The statement of Mr. Kamara’s lawyer should be seen as a media statement that does not fully reflect the reality of the matter, “Pokorný told Práva.

Pokorný pointed out that the Scottish authorities are proceeding in the same way when investigating the post-match incident, in which Kúdela Kamarou was to be physically attacked inside the stadium.

According to lawyer Jiří Matzner, the police officers probably only have evidence from the players of the Scottish club. So they should also get information from the Slavists. “I think it’s just a statement against a statement,” Matzner told Práva.

The lawyers are convinced that Kúdela has no reason to hide from the prosecution in any way. “I don’t think there is a danger of an arrest warrant being issued. But cooperation would be requested that the interrogation would take place in the Czech Republic, where the police would arrive. Or Kúdela would go to Great Britain and submit to interrogation or criminal proceedings there, “lawyer Jaroslav Ortman told Práva. “Wanting to listen to him is common practice,” Matzner added.

According to both experienced lawyers, Kúdel is probably not in danger of ending in custody in this case. “There is no danger that he will not cooperate or that he will not know where he lives. I really don’t see any reasons for imposing detention, “Matzner specified.

Injury is a case for the police
In the same match, even before Kamara’s incident with Kudela, Slavic goalkeeper Ondřej Kolář was injured after a brutal foul, who suffered a fracture in his face. If a similar foul happened in the Czech Republic, according to lawyers, the case would be dealt with by the police.

“I read a statement that he intended to injure the goalkeeper. This fulfills the conditions for him to be prosecuted in the Czech Republic, “said Matzner. “It was a foul beyond criminal law,” said lawyer Ortman.
