TIN: The Tax Office requires a guarantee of up to 500,000 euros from former tax evaders – 2024-04-12 01:10:28

By paying a guarantee which cannot be less than 3,000 euros nor more than 500,000 euros, natural and legal persons whose TIN has been deactivated after tax evasion, insolvency, bankruptcy will be able to resume business activity.

Especially for cases of smuggling, the guarantee reaches 1,000,000 euros. The duration of the guarantee cannot be less than two years and more than six years.

Guarantee for VAT recovery

According to the provision of the draft law on the Tax Procedures Code that is in the Parliament, the Tax Administration requires a guarantee from any natural or legal person or entity that is going to carry out a business activity, in particular from:

a) a natural person who has gone bankrupt or has become insolvent, after the suspension of the use of the A.F.M. of, if at the time he submits an opening statement he has a total basic overdue debt from income tax, VAT, withheld taxes from salaried work or fines, of at least 100,000 euros,

b) by persons after whom the period of suspension of use of the A.F.M. has expired. their,

c) a natural person who has been a director, executive chairman, administrator, executive member of the board of directors, managing director or a person entrusted with the management of a legal person or entity or a person connected with another natural or legal person or legal entity, or a shareholder or partner with a participation rate of at least 33% of a legal person or legal entity, whose A.F.M. has been suspended or disabled

d) entities that have, at the time they submit an opening statement, a total basic overdue debt from income tax, VAT, withheld taxes from salaried work or fines, of at least 300,000 euros

e) legal entities, which they set up or in which they participate with a percentage of at least 33% or which are managed by natural persons who have, at the time they submit an opening statement, a total basic overdue debt from income tax, VAT, withholding taxes from salaried work or fines, at least 300,000 euros.
