TikTok is suing the US to block its ban – 2024-05-08 10:27:10

TikTok is fighting back in its fight with the US after it sued the US government in an attempt to stop enforcement of a bill passed last month that seeks to force its Chinese parent company ByteDance to sell the app.

The firm claims The Protecting Americans From Foreign Adversary Controlled Applications Act, signed by President Joe Biden as part of a broader $95 billion foreign aid package, is so “manifestly unconstitutional” that its supporters are trying to introduce not as a ban, but as a regulation of TikTok’s ownership.

For the first time, the US government is singling out a social media company with a possible ban, something free speech advocates say is more common in repressive regimes.

Congress considers the platform a national security threat because of its ties to the Chinese entertainment company.

According to the company, invoking national security concerns is not a sufficient reason to restrict free speech and that the burden is on the federal government to demonstrate that such restriction is justified. “He has not met that burden,” the lawsuit states.
