Three former ANI executives are charged with irregularities in Ruta del Sol II • La Nación

According to the Prosecutor’s Office, the three defendants would have had undue interest in several of the others that were added to Ruta del Sol 2. They would also have guaranteed payments for unfinished works.

The Attorney General’s Office charged three former directors of the National Infrastructure Agency (ANI) as allegedly responsible for the crime of undue interest in the execution of contracts.

These are the vice president of Contractual Management, Camilo Mendoza Rozo; the former Project Manager, José Andrés Torres Rodríguez; and the former legal vice president, Héctor Jaime Pinilla Ortiz. These people would have irregularly processed and allowed the approval of the others 1, 2, 4, 5 and 8 of concession contract 001 of 2010, ‘Ruta del Sol II’.

The evidence indicates that, in the exercise of their positions, they formulated, endorsed and signed convenience studies, contracting committee minutes, among other actions that gave viability to the additions made to the road project. In this way, the financial and technical conditions of the contract were modified and adjusted in favor of the concessionaire, of which Odebrecht was a part, without there being serious and complete studies.

Specialized experts from the Prosecutor’s Office confirmed that one of the additions approved the reduction of the asphalt footprint, which reduced the quality of the work and reduced construction costs in favor of the contractor.

Likewise, they confirmed that payments were authorized for unfinished journeys, advance payments were made, deadlines were extended, work schedules were adjusted, sanctions for delays or absence of environmental licenses were omitted, the construction of the infrastructure was added.Puerto Boyacá intersection that had no relation to the original contract, and resources and future terms were committed without authorization from the National Council of Economic and Social Policy (CONPES) and the Superior Council of Fiscal Policy (CONFIS).
