Until November 15, 2020 you could get your lost money from the Federal Republic of Germany – but very many did not notice this first or trusted that the payment would come automatically, because after all, there are already many at ZURICH / KAERA and the insolvency administrator Has completed forms. State liability? Decision of the Berlin Regional Court: No – but would ZURICH have to pay?
Unfortunately, we were unsuccessful with our state liability suits. In our complaints, the Berlin Regional Court pointed out, among other things, that ZURICH had to pay everything in full and therefore no state liability could be considered. The court’s argumentation was ultimately very good, which is why we were convinced: We recommend suing the ZURICH package travel insurance company. We have already filed a large number of lawsuits.

To date (as of October 6th, 2021) there has been no judgment in our lawsuits against ZURICH. However, there have already been several negotiations: the court has not yet formed a final opinion. However, both sides have good arguments. Our arguments are:
- Limiting the sum insured is not permitted,
- the sum insured is to be doubled due to two business years and
- the sum insured must be increased as the return costs may not be deducted from the sum insured.
The first judgments will be given at the end of October. But either way, that won’t be the last word, as the loser is bound to appeal.
