Is there ‘code 95’ on your driver’s license card? Or 01.06? That means you have a driver’s license with conditions. More than 750,000 Dutch people are affected by this. Here we explain what it means for you.
Your state of health must of course not affect road safety, but if you are chronically ill or have another disability, you naturally also want to be mobile. After an assessment by a doctor and/or another expert, you can therefore get or keep your driver’s license under certain conditions.
CBR spokesperson Femke van Zijst explains. “If it has been recorded in the driving license register that you are dependent on an adapted motor vehicle or the use of aids for your fitness to drive, then you may not get behind the wheel in any other way according to Article 16 of the Driving License Regulations. To go beyond the driving license register To be able to check whether your driving skills are subject to reservation, there is a code set by the ministry on your driver’s license.”
These codes have been drawn up by European governments. In addition, there are also a number of codes that only apply in the Netherlands. Such a code may mean that you must adhere to certain rules of conduct (for example, driving for a maximum of four hours a day or only making private trips), but also that you may only drive a vehicle that is adapted to your situation. Think of hand-operated throttle or driving with a joystick when you can’t use your legs.
Code on driver’s license is an indication, details are in the driver’s license register
Not the whole code is mentioned on the pink card. Only the main category is indicated. For example, anyone who has code ’01’ on their driving license is only allowed on the road with a visual aid. The digital driving license register contains the further specification. If you have the ‘01.06’ restriction, you are obliged to wear glasses or contact lenses when you are behind the wheel.
If you have an adapted motorcycle due to a physical disability, the driver’s license will state exactly which changes must have been made. For example, if you have ‘44.08’ on your driver’s license, then the seat height of the motorcycle must be such that you touch the ground with both feet when standing still.
Criminal offense if you do not comply with the conditions
If you do not comply with the indicated codes, it is not just a violation. You then drive without a (valid) driver’s license and that is a crime. In addition, you are not insured. If you cause an accident, the damage will be for your own account.
You may be confronted with a code when you first apply for a driving licence. Due to circumstances, your health situation may change to such an extent that you have to be (again) examined, such as partial paralysis due to a stroke or amputation of a limb.
If a CBR doctor determines that you are allowed to drive (again) under certain conditions, you must apply for a new driving license within four weeks after the letter has been sent. If you do not agree with the conditions imposed, you can appeal.
Code can also have an administrative reason
Incidentally, a code on your driver’s license does not always have to do with a health situation. A well-known example is code 95. Whoever has this after the section C(E) and D(E) on his driving license must have taken an exam for the basic competence for professional drivers. Previously this was called the driver’s diploma. Code 95 also means that you must follow refresher courses. And do you have code 81 on your driver’s license?
