This could be a bombshell. Will the CJEU decision change the transfer market?

After Diarra ended his contract with Lokomotiv Moscow in 2014, the club decided to sue the player for damages for breach of contract. at last FIFA have imposed a huge €20 million fine on Diarra and a ban from playing, which was upheld by the Court of Arbitration for Sport (CAS).

However, the Frenchman did not accept the decision and in 2015 he filed a new court case, arguing that the FIFA ban prevented him from taking a job with the Belgian club Charleroi. The former footballer claims FIFA’s actions breached EU rules on freedom of business activity and movement of workers.

As pointed out by the first Advocate General of the CJEU, Maciej Szpunar, quoted by the Daily Mail, FIFA rules limit the ability of players to change clubs and hinder players who want the contracts to terminate them without “just cause”. Szpunar stressed that the relevant rules could conflict with the rules of competition between clubs, which is against EU law.

The decision of the Court of Justice can have a major impact on player movements. If Diarra wins the case, FIFA rules may need major changes to bring them in line with EU standards, which will place greater emphasis on employment flexibility and freedom to work.

Players will get more rights, including the ability to end the contract early, approaching the conditions known from other industries.

However, if the court sides with FIFA, Diarra will have to pay compensation to Lokomotiv Moscow.
