Zico Leonard Djagardo Simanjuntak, a lawyer who is also the plaintiff in case Number 103/PUU-XX/2022, said he would report Constitutional Court (MK) the Polda Metro Jaya. This report stems from allegations that there was a change in the excerpt of the decision between what was read out by the judge in the courtroom and what was on the copy of the decision.
“I will report this to Polda Metro Jaya on Wednesday (1/2/2023), will continue with the crime,” Zico told reporters at the Republic of Indonesia Constitutional Court building, Central Jakarta, Monday (30/1/2023).
He also urged the Constitutional Court to investigate this matter internally before the criminal case started. According to him, the perpetrators related to this problem must be dealt with ethically first.
“If the Constitutional Court cannot process this before a road sentence, before there is a suspect from the police, it means that the Constitutional Court is incompetent. please just disband it,” he concluded.
Zico further said that the establishment of a new institution, the Honorary Court of the Constitutional Court (MKMK) to handle this case, was an ineffective step.
“I’ll be honest, I’m not satisfied. This MKMK only tries judges, clerks, and the secretary general who check? No there is. So actually it is said that MKMK also does not solve the problem,” he said.
According to him, editorial changes to the substance of the decision he was suing were not made by one person. He suspected that these changes were carried out systematically.
“The decision was changed, the minutes were changed, that’s why I suspect this was intentional, because the minutes were changed. If the minutes haven’t changed, maybe typos are still possible, this minutes have changed,” he added.
“I will prosecute everything, because I don’t know who is responsible. I am forced to report everything, how will the process be, so that the internal MK will see how it goes and the police as an external party,” he added.
Previously, the Constitutional Court (MK) was suspected of changing the substance of the judicial review decision on case number 103/PUU-XX/2022. This is because the sentences in the excerpt of the decision read out by the judge in the courtroom are different from those in the copy of the decision.
