Third-party insurance in the event of an accident at fault (or not at fault)

What is third party insurance?

The third-party formula is the simplest coverage, but it is also and above all the one that is mandatory. According to article L. 121-1 of the Insurance Code, all land motor vehicles must be covered by third-party insurance.

It includes the civil liability guarantee. This guarantee of your car insurance applies in the event ofresponsible accident. If the third party is the victim of property damage or bodily injury, your liability insurance will compensate them.

You are responsible for an accident: what does the insurance cover?

If you have only subscribed to a third party insurance simple, the insurance only covers the victim and the damage suffered. Clearly, your responsibility being engaged, your insurance company will not offer you compensation for the damage caused to your car.

This compulsory insurance is therefore insufficient. It is, most of the time, taken out by drivers who have an old car of little value and wish to reduce the amount of their insurance premium.

You are not responsible: what is happening?

Conversely, if the third party is responsible for the accident, whatever the car insurance plan that you have subscribed to, it is not this one which intervenes. The damage suffered will be compensated by the insurance of the person responsible for the accident. who will, again, take charge of material damage and bodily injury.

L’third-party insurance in the event of a non-responsible accident is therefore not useful, even if it remains mandatory.

Accident and lack of insurance: the consequences

This is a more problematic situation. L’auto insurance is mandatory, initially, you will be penalized if you are not insured. If there is no repeat offense and no other offense committed at the same time as the lack of insurance, you will pay a fixed fine of €500 which can be reduced to €400 and increased to €1,000.

On the other hand, if you are responsible for an accident and you have not taken out third-party insurance, it is the compulsory insurance guarantee funds, the FGAO, which compensates the victim. Do you think the problem is solved then? It is not so. Indeed, the FGAO will then turn against you to ask you to reimburse it. This fund may even apply a surcharge.

Clear, lack of insurance is a major risk that can jeopardize your financial situation in the long term.

Additional guarantees for better protection

L’third-party insurance not sufficientyou have the option of take out a more protective insurance contract. You are then offered two solutions:

  • l’additional third-party insurance : this is insurance which, beyond the basic cover, offers you additional cover such as fire, glass breakage, theft and attempted theft, or even vandalism. It can include other guarantees such as natural disasters and climatic events (storm, hail, etc.);
  • l’Back to back insurance is the most complete insurance formula. It insures all risks thanks to the all-accident damage guarantee. This time, even in the event of a responsible accident, your insurance covers your repairs or provides compensation if your vehicle is unusable. It then takes into account the obsolescence, unless you have taken out the replacement value guarantee.

Some guarantees are then offered as an option, for example we can cite:

  • the 0 km breakdown assistance guaranteewhich allows support (on-site repairs or towing) even in front of your home;
  • the vehicle loan guarantee : a replacement vehicle is entrusted to you free of charge for the duration of the repairs.

The cost of third party insurance

The amount of the contribution of a third-party insurance is low insofar as the level of guarantee is low. The insurance company takes into account the risk and the amount of coverage in the event of a claim.

It also takes into account the following elements:

  • the model and make of the vehicle;
  • the date of first circulation;
  • the odometer reading;
  • the planned annual mileage;
  • use (personal, home/work, business);
  • the place of parking at night;
  • the driver’s profile, it being understood that a young driver pays a premium due to his inexperience. A driver with a malus will also pay an additional premium.
