It’s a love story that ends badly. Very bad too. Starts in February 2021. The couple meet on the Internet. They are twenty years old. The relationship changed a few months later, on July 9th.
That evening, the boy goes out to a Luxembourg bar with friends. He drank too much. That doesn’t stop him from knocking on the door of his girlfriend who lives in Thionville. She doesn’t respond to his messages and it pisses him off. He ended up opening the door for him, to avoid waking the whole building. He will then describe an unprecedented scene of violence to the police. He says that her partner throws himself on her, beats her. She falls on her bed, he beats her, insults her, pulls her hair, holds her down and then sticks his fingers into her panties. He is convinced that she is cheating on him with the neighbor and that they have just had sex. The victim explains that his attacker requires digital penetration to go through with it. Eventually he will be able to escape. He will file a complaint the next day. He is prescribed seven days of total incapacity for work.
The boy, tall, athletic, visibly reassured, showed up at the criminal court bar on Tuesday 18 October, more than a year after the events. He recognizes the blows, but he denies putting his face on the hob in the kitchen. Above all, he denies the sexual assault for which he is also being prosecuted. Although he admits his memories of the evening are hazy.
Justice taken for granted?
“I am not in favor of reduced-price justice,” says the defendant’s lawyer, Me Tibéri. In fact, the victim describes a rape, characterized by an imposed penetration. “Then he should have been judged first the criminal court “Says the board. But justice has preferred to reclassify the facts as sexual assaults and go to the criminal court. The lawyer does not fail to underline it, to be amazed and then to explain it for the lack of evidence in his opinion sufficiently convincing.
The medical certificate drawn up three days after the attack attests several bruises found on the young woman’s body and face. But the doctor cannot confirm the sexual attack. The victim will try to make the ex-spouse confess in an email where she records every detail of the scene suffered in her apartment. The person concerned, presumably devastated, will reply apologizing. It will not be enough to condemn him.
The court acquits the accused of the sexual assault. On the other hand, he pronounces one year of imprisonment including six months of detention for physical violence. A sentence that he will execute under an electronic bracelet. The remaining six months suspended will be subject to the obligation to treat his alcoholism problems and to compensate his ex in the next two years. He will also be prohibited from contacting her for three years.
