Thionville. Sentenced for sending the photo of a naked teenager

The dissemination of images of a sexual nature without the authorization of the person concerned is punishable by law. The case brought before the criminal court of Thionville, Tuesday, February 14, reminded a young man of 22 years.

The photo in question is that of a 16-year-old teenager, a student in a medical-educational institute in the Orne valley. She says that the defendant took her without her knowledge. According to her, they would have had a brief romantic relationship, lasting a few days. The boy then sent this photo to another girl. And the latter transmitted it to a third student of the IME. The special educators discovered her and reported the facts to the authorities.

Fine and compensation

The facts date back to February 2019. The defendant acknowledges that he sent the photo. But he denies having taken it. He explains that the teenager does not know how to write, “that’s why she sent me photos”, he justifies at the bar. The single dissemination of this image is enough to bring him to justice. No need to post it on a widely consulted website for the offense to be constituted.

He is fined 300 euros. He will also have to compensate the victim up to 200 euros for his moral damage.

The young man is not the only one to be implicated in this case. The girl who received the photo and then forwarded it to another student at the IME was also sentenced for the dissemination of the sexual image, according to a simplified criminal procedure called plea-guilty.
