In her claim against Borisov, Ficherova says that the false statements are aimed at discrediting her and implying that she was not appointed due to personal and professional qualities, but to export and provide information about the Ministry of Internal Affairs and the services of “the one who sent her there “.
According to her, she was worried about herself and her loved ones because there were allegations that she had committed a crime, such as the transmission of classified information.
Borisov replied that in his statement Ficherova was neither named nor referred to, therefore her honor and good name were not affected. According to him, she interpreted his statements in her own way and that, having held a position in an institution, she should be prepared to endure criticism, as it is not permissible to restrict freedom of speech.
The SRS accepted a forensic psychological examination, from which it was established that Borisov’s statement that he was giving information was a stressful event for Ficherova, during which she had an adjustment disorder – anxiety, restlessness, a sense of inability to cope with the situation, to plan for the future , to some extent disrupts the performance of routine daily activities, the court decision explained.
The court does not agree with Borisov that it cannot be proven who is the addressee of his statement. He doesn’t just talk about the chief of staff, but explicitly states that she resigned the day before. This clearly and unambiguously proves that he is talking about Ficherova.
The decision of the district court is not final and may be appealed to a higher court.
