A federal judge dismissed the amparo trial filed by Mario Aburto Martínez, confessed murderer of Luis Donaldo Colosio, against the determination of the Attorney General’s Office (FGR) not to pursue criminal action against anyone involved in the alleged torture of the who claims he was a victim.
The head of the Second District Court in Criminal Matters, Paloma Xiomara González, annulled the demand for guarantees. Without her, she did not make public the reasons for the ruling. “Agreement is issued. Please notify yourself personally… Meaningful initial resolution. Dismissal,” states the judge’s determination that is published this Wednesday.
The legal defense of Aburto Martínez presented the lawsuit on March 15 before the Second District Court of Amparo in Criminal Matters. Among the acts that he claimed were: “The consultation to determine the non-exercise of criminal action.”
At the end of February, the FGR informed Judge Xiomara González that no elements were found that evidenced acts of torture committed against the confessed murderer of Luis Donaldo Colosio after his arrest.
The prosecution assessed that he was not a victim of torture during his arrest and transfer to Mexico City, after having murdered Luis Donaldo Colosio Murrieta, on March 23, 1994, at the end of a rally in the Lomas Taurinas neighborhood, in Tijuana, Baja California.
Since November 28, 2023, the prosecutors notified Aburto Martínez of the query presented by the Special Prosecutor’s Office for the Investigation of the Crime of Torture in preliminary investigation 2080/94, considering that it is not proven that he had been tortured.
Mario Aburto’s complaint is in the National Human Rights Commission (CNDH) where he accused of having received threats to pretend to be Colosio’s murderer.
