They distribute blame throughout the Senate for omission with the Inai

The president of the Political Coordination Board of the Senate, Ricardo Monrealacknowledged that the judge who ordered the appointment of the commissioners of the National Institute of Transparency, Access to Information and Protection of Personal Data (INAI) could resort to coercive measures against him, but he specified that the responsibility lies with the entire legislative collegiate body.

Given the pending appointments they have, he pointed out that in all cases of resolution, the judge can resort to other measures before the contempt in which they have incurred.

“When there is contempt of a jurisdictional resolution, the judge issuing the resolution has the right to use means of enforcement, and the means of enforcement are reprimands, economic sanctions, or even dismissals”, he commented.

However, when questioned about the case of the senators because they have constitutional jurisdictionremembered that then would have to be removed first to submit them to a criminal or civil administrative procedure.

“They are not from people, it is from the legislative body. It is not a person, it is not the coordinator of the PRD group or the senator so-and-so, no, is the legislative body (…). It is the collegiate body that incurs in this responsibility. Here it cannot be argued ‘it is that the minority does not want it, or the majority does not want it’, no, it is the integral legislative body”, he pointed out.

In this regard, the vice coordinator of the blue and white in the upper house, Kenia López Rabadán, criticized that the appointments of the commissioners and the operation of the body continue to be detained by the cherry bench.

In its edition this Tuesday, La Razón reported that disagreements have increased by 22.4 percent due to lack of transparency of public administration entities.

For this reason, the blue and white senator demanded that the legislative majority of Morena in the upper house put aside internal disagreements to carry out the appointments.

He stated that it is evident that Morena does not like transparency, because it is through this medium that the anomalies of President Andrés Manuel López Obrador have been known.

“López Obrador does not like transparency, nor does Morena, because thanks to transparency we have the data on cronyism, on the benefits of the President’s family, of the Gray House;

“We knew exactly what was happening thanks to transparency, that’s why he doesn’t like it, but we are obliged, from the Senate of the Republic, to make these proposals,” he declared.

López Rabadán said that, for this reason, they will demand that this week the Senate make the corresponding proposals to elect the pending INAI commissioners.

“It is obligatory to demand the majority of Morena in the Senate to agree and we can now discuss the Senate’s proposals for the Inai (…). We must remember what the senator from Morena (Eduardo Ramírez) said, that the proposals were not made because in Morena they had to agree and, well, how terrible, but unfortunately they have the votes to paralyze this type of decision.

So we will continue to demand that this week the Senate of the Republic make the corresponding proposals and thus can guarantee transparency.

They demand a resolution to the INAI paralysis from the Senate

The Latin American Network for Legislative Transparency referred to the omission of the Mexican Senate, and asked for a solution to the “INAI paralysis” that from the perspective of this body left the Plenary of the Institute inoperative.

“Since April first, the plenary session of the National Institute of Transparency, Access to Information and Protection of Personal Data of the INAI is unable to log in because it does not have a sufficient legal quorum to do so, leaving the right to know unprotected”, reports the international organization.

The Latin American Network for Transparency reported that the INAI operates with 7 commissionerswho jointly make the decisions of the entity and issue the regulations required to guarantee the rights of access to public information and protection of personal data.

The agency indicates that in recent days the term of the commissioner expired Francisco Javier Acuna Llamas and as a consequence, the entity now has four commissioners and given this situation, the INAI is unable to make legal decisions.

“Although weeks before the Senate had selected the remaining members, President Andrés Manuel López Obrador objected to the two proposed candidates, arguing that one of them was not suitable for the position. New attempts to fill those positions failed due to the lack of agreement between the parliamentary groups in the Senate”, he indicated.

They also indicated that in this context, the Latin American Network for Legislative Transparency (RLTL) urges the Senate of the Mexican Republic to “comply with their constitutional obligations and redouble efforts to reach the necessary consensus and designate the remaining commissioners.”
