Mexican lawyers presented this Sunday, April 28, 2024 before the General Prosecutor of the Republic (FGR) a criminal complaint against the president of Ecuador, Daniel Noboaand other authorities of that country for the violent invasion of the Mexican embassy in Quito last April 5.
In a press conference, criminal lawyers said that Noboa “must be investigated and punished” for ordering the raid on the diplomatic headquarters, for the violence carried out against embassy officials and for the deprivation of liberty and kidnapping of the former vice president. Jorge Glas (2013-2017), who had been seeking asylum there since December.
Additionally, for the injuries and illegal detentions against Mexican officials, and the espionage and harassment against the diplomatic headquarters and for the damage that has been caused.
Raúl Armando Jiménez Vázquezprofessor of International Criminal Law at the Faculty of Law of the National Autonomous University of Mexico (UNAM), indicated that the Prosecutor’s Office is competent to investigate allegedly illegal acts.
This, because the Federal Penal Code establishes that crimes committed by Mexicans or foreigners in Mexican embassies and delegations are considered to be executed in national territory.
He added that the FGR is “equipped” to investigate, pursue, prosecute and punish those allegedly responsible for the crimes classified in the Federal Code and in the applicable instruments of Conventional International Law, “whether they are made in its territory or against its nationals.”
He explained that in the case of the conduct of the Minister of Government of Ecuador, Monica Palenciawho is Mexican by birth, the crime of treason can materialize, in addition to other crimes related to the illegal tapping of the telephones and communications of the Mexico’s embassyand harassment.
The complainants pointed out the existence of other possible crimes such as riot, international terrorism, criminal association, home invasion and assault, injuries, illegal deprivation of liberty and damage to other people’s property.
The litigants expressed their confidence that the alleged crimes committed by Noboa and other authorities will be punished by the Mexican judicial system.
The complaint is filed two days after the international Court of Justicethe highest court of the United Nations (HIM), start listening to the arguments of Mexico and Ecuador regarding the events of April 5.
The controversy between the two began after the police raid on the Mexican Embassy on April 5 to take away the former vice president. Glassheltered there since December in the face of a corruption process.
And it has grown because an Ecuadorian court declared on April 12 the arrest of Glas inside the diplomatic headquarters as illegal and arbitrary, although he was imprisoned as he had yet to serve his sentence for the Bribery case and for illicit association in the Odebrecht case.
On April 15, Glas sent a letter to the Mexican president, Andrés Manuel López Obradorin which he asks for help and assures “he is in the worst prison in Ecuador” and who is on a “hunger strike.” EFE
