/ world today news/ The Plovdiv District Court confirmed a few days ago the penal decree imposed on EVN by the State Environmental Protection Agency, by which the Austrian company was fined the record amount of BGN 1 million.
The sanction is in the maximum amount provided for in the Law on Energy, and after the decision of the Plovdiv District Court, it is subject to appeal in the Administrative Court – Plovdiv.
The fine is imposed by the State Environmental Protection Agency on EVN because of the deduction that the company made at the beginning of the year for the purchase of green energy from the money it owes to NEK. CEZ and Energo-pro acted in the same way then, and the former minister Dragomir Stoynev threatened that this could even lead to the revocation of the licenses.
The settlement of compensations is delegated to DKEVR, and the arbitrary interception by EVN turns out to be a seizure of the regulator’s powers, the magistrates ruled. On January 22 of this year “EVN Bulgaria Elektrosnabdevane” EAD deducts BGN 24,993,299.29 from its total debt for electricity supply to NEK, which is in the total value of BGN 49,095,589.29. The amount deducted is for the compensation that NEK owes the company due to imputations by the electricity distribution companies companies commitment to buy electricity produced from renewable energy sources, the price of which is much higher. In the course of the case, EVN pointed out that the Energy Act lacks an express prohibition on interception, but in their reasons, the judges explicitly emphasize that the powers in this direction are delegated only to the DKEVR.
