According to the indictment, to which Europa Press has had access, the events occurred during the month of September 2018, when the defendant, DRM, bought a mobile phone from the niece of his sentimental partner, B., who then had 12 years old, unbeknownst to his mother, A.
Thus, during that month, the defendant was left with the minor to give him the mobile phone and two SIM cards, one in his own name and, later, another in another name.
In October, the defendant began to talk to the minor on Instagram and WhatsApp, asking for a video masturbating, to which the girl refused, even so, both exchanged photos and videos of their genitals.
On October 26, DRM requested a video call with the minor, and when she agreed, the defendant dropped his pants and began to masturbate, at which point B. hung up the call. Days later, on the 30th of that same month, the mother and the minor denounced what had happened.
Facts that the Prosecutor’s Office considers to constitute a crime of corruption of minors for which they ask for five and a half years in prison, in addition to the special disqualification from the exercise of any profession that entails contact with minors for 11 years. It prohibits him from approaching B. within 500 meters for 11 years.
The Public Prosecutor also accuses him of a crime of exhibitionism for which they ask him for 10 months in prison, as well as the prohibition of approaching the minor within 500 meters for 2 years and the disqualification from working with minors for 4 years and 10 months.
The measure of probation will also be imposed for 8 years, and DRM must compensate B. in the amount of 6,000 euros for moral damages.
