On Wednesday, lawyer Jorge Abud Bannen arrived before the 21st Civil Court of Santiago, a court before which he requested the forced liquidation of the company Chec Chile, a local subsidiary of the holding China Harbor Engineering Company Ltd. (Chec), in charge of the development from the Las Palmas Reservoir. And represented – read in the court action – by Wang Minghu.
The lawyer details being the owner of four invoices that were issued to the machinery rental company Vectorial Mineria, which was in charge of the construction project of the hydraulic diversion tunnel in Las Palmas Reservoir. In total, the documents total about $ 200 million. Said loans were assigned to Jorge Abud Bannen y Compañía by the aforementioned company.
“In relation to the enforceability of assignments to the debtor, that is, to the company Chec Chile SpA, it was (made) known to the obliged to pay them, through their annotations in the Electronic Public Registry of Credit Transfers” , it reads. It adds that “these documents, upon being presented for payment, were received in accordance, on the same date they were issued, without the defendant claiming against their content or the total or partial lack of provision of the services described in papers”.
It even details that the respective preparatory management was carried out first. The firm was notified and finally, on September 24, it was certified that the funds had not been deposited, which is why the request for forced liquidation has now been activated. Consequently, in my capacity as creditor, I have come to request a declaration of the forced liquidation of Chec Chile SpA, since the cause indicated in number 1 of article 117 of Law No. 20,720 has been verified, as the defendant a Debtor Company (…) and having stopped paying an obligation with the applicant ”.
Chec was the first Chinese company to be awarded a tender in Chile. In 2018, the development of the Las Palmas Reservoir, in Region V, was won. Today, the firm is asking the Ministry of Public Works to suspend the concession due to lack of water. In addition, it has developed works in the ports of San Antonio and San Vicente Terminal Internacional.
