The Prosecutor’s Office requests 3 years in prison for a lawyer from Vilagarcía de Arousa who will be tried this Tuesday in the second section of the Provincial Court of Pontevedra for appropriating 40,000 euros from a client’s bail.
According to the public indictment, this lawyer assumed the defense of a man who entered provisional prison in 2008 for a crime of drug trafficking and by order of a court in Cambados. A year later, said court decreed bail of 40,000 euros.
The client’s mother withdrew the money, which the lawyer deposited, becoming a guarantor, to obtain the freedom of his client. Once the procedure was completed, the enforcement service of the Criminal Chamber of the National High Court agreed to return the bail deposited at the time.
Thus, that money was delivered to the lawyer in June 2017 but he, with the intention of obtaining a financial benefit, kept the entire sum and did not return it to his clients.
For these facts, the Prosecutor’s Office accuses him of a crime of misappropriation, and asks that he be sentenced to 3 years in prison and the same time of professional disqualification, as well as the payment of a fine of 2,700 euros. Finally, he requests that he compensate the heirs of his client (already deceased) in the sum of 40,000 euros plus legal interest.
