The Presidential Delegation of O’Higgins called a meeting with the National Consumer Service, the Seremi of Economy and the mayors of the O’Higgins region to communicate the actions that SERNAC is carrying out with the company CGE, so that they compensate all affected families as soon as possible.

In this context, the Voluntary Collective Procedure has already been opened with the company CGE, although the Presidential Delegation assures that the company has not yet given a response on whether it will participate in this voluntary procedure, although it is within the timeframes contemplated by the process.

According to the government, this extrajudicial action, led by SERNAC, is the quickest, most efficient and universal way for residents who have suffered power outages to obtain compensation in an efficient and timely manner.

This mechanism can also be used to seek compensation for collateral damage suffered by people, such as loss of food, medicines and damaged appliances, with flexibility in proving losses, such as photographs or videos, and not just with purchase receipts.

The meeting also agreed to pause class action lawsuits while awaiting the outcome of this procedure and evaluating its results. Authorities say that this flexibility would allow “guaranteeing that compensation is adequate and fair for all those affected, while maintaining the option of resorting to legal action if necessary.”

The Presidential Delegate of O’Higgins, Fabio López, said: “This procedure is key to defending the rights of our neighbors in the face of the crisis caused by the power outage in recent days. We call for coordinated work so that the affected people receive adequate compensation for their impact.”

Let us remember that, following a reform to the Consumer Law in 2018, it establishes for cases of unjustified interruption of basic services, the payment as a basis of 10 times the daily value of the last account statement with respect to, in this case, the energy not supplied.
