The chief prosecutor of Chillán, Sergio Pérez Nova, reported that the Public Ministry will appeal the decision of the Chillán Guarantee Court that rejected the request for preventive detention made by the Prosecutor’s Office against Felipe Morales Campos, a driver who, while intoxicated, collided with a motorcycle, causing the death of a young woman, on the way to Huape.
The prosecutor explained that the incident occurred in the early morning of the 1st of this month when the accused was driving a truck along Sepúlveda Bustos Avenue, at 157 kilometers per hour and with 1.8 grams of alcohol per liter of blood. Under these conditions, he collided with the motorcycle, causing the death of a young woman who was the co-pilot and injuries to the driver of the minor vehicle.
At the hearing held yesterday Sunday, the Prosecutor’s Office requested preventive detention for Felipe Morales, since he was charged with driving while intoxicated, causing death and less serious injuries, and for driving over the permitted speed in an area where the maximum speed is 50 kilometers per hour.
Prosecutor Sergio Pérez explained that “due to the number of crimes, the severity of the assigned sentence and because he must serve at least one year of deprivation of liberty, we requested this precautionary measure, but the court considered that the need for caution was satisfied with the arrest. “total domiciliary”.
He added that “we are not satisfied with that decision, so today we will file an appeal before the First Court of Appeals of Chillán so that it can amend, in accordance with the law, the resolution of the Guarantee Court.”
